1Introduction

These Terms & Conditions (“Terms”, “Terms and Conditions”) govern your access to and use of Zeb e Tann (“Website”) and your purchase of products from the Website. The Website is operated by Live India (“Company”, “we”, “us”, “our”).

By accessing the Website, creating an account, placing an order or purchasing any product through the Website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or place an order.

These Terms are subject to applicable laws of India. Nothing in these Terms is intended to exclude or restrict any consumer right or legal remedy that cannot lawfully be excluded or restricted.

2Eligibility to Use the Website

You may use the Website only for lawful purposes. By using the Website, you represent that:

Where an order is placed on behalf of another person, the person placing the order is responsible for providing accurate information and ensuring that the recipient information is correct.

3Account Registration

Where OTP authentication is used, customers are responsible for maintaining control over the mobile number associated with their account. Customers should not share OTPs or account verification information with others.

Actual product colour may appear slightly different depending on the customer’s screen, display settings, lighting or photography conditions. Minor variations in fabric, embroidery, printing, texture, stitching or finishing may occur due to the nature of manufacturing and fashion products.

Where a product has specific characteristics or variations, such information may be disclosed on the relevant product page.

5Product Availability

Products displayed on the Website are subject to availability. A product may become unavailable because of:

  • Inventory changes;
  • Stock discrepancies;
  • Technical errors;
  • High demand;
  • Manufacturing or supply issues;

If a product becomes unavailable after an order has been placed, we may contact the customer and provide an applicable resolution, including cancellation and refund where appropriate. Nothing in this section limits any mandatory consumer rights.

The final amount payable may include:

7Pricing or Listing Errors

Although we take reasonable steps to maintain accurate product information and pricing, technical or human errors may occasionally occur. If a material pricing, product or listing error is identified, we may contact the customer and provide an appropriate resolution.

Where an order cannot reasonably be fulfilled at the incorrect price, the Company may cancel the affected order and refund any amount already paid, subject to applicable law.

8Promotions, Discounts and Coupons

Promotional offers, discounts, coupon codes and other promotional benefits may be subject to specific conditions. These conditions may include:

  • Minimum order value;
  • Eligible products;
  • Maximum discount;
  • Validity period;
  • One-time use;
  • Customer/account eligibility;
  • Payment method;
  • Other promotional conditions.

The applicable promotional terms will be displayed with the relevant offer. Unless expressly stated otherwise, promotional offers cannot be combined. The Company may withdraw or modify a promotional offer where permitted by applicable law.

9Placing an Order

Customers may place an order by completing the checkout process on the Website. Before placing the order, customers should verify:

  • Payment method;
  • Total payable amount.

An order confirmation indicates that the order has been received. Fulfilment remains subject to product availability and other applicable conditions.

10Order Acceptance

The Company reserves the right to cancel or decline an order where permitted by law in circumstances including:

  • Material pricing or listing errors;
  • Suspected fraudulent activity;
  • Payment issues;
  • Incorrect or incomplete delivery information;
  • Technical errors;
  • Delivery restrictions;
  • Force majeure circumstances;

If payment has already been received for an order that is cancelled by the Company, the applicable amount will be refunded through the applicable refund mechanism.

11Order Modification

Customers should verify their order information before completing checkout. After an order has been placed, modification of:

  • Product;
  • Size;
  • Colour;
  • Quantity;
  • Shipping address;

may not be possible depending on the order’s processing stage. Customers should contact the Company as soon as possible if a correction is required.

12Cancellation

Customers may request cancellation before the order reaches the applicable fulfilment/shipping stage. Once an order has been packed, dispatched, shipped or handed over to a courier, cancellation may no longer be operationally possible.

Where cancellation is unavailable, the customer may use the applicable return/refusal process where available. Cancellation rights that are mandatory under applicable law will continue to apply.

13Payment

Payments through the Website may be processed through Razorpay, an independent third-party payment service provider. Available payment methods may include:

  • Credit/debit cards;
  • UPI;
  • Net banking;
  • Other payment methods made available through the payment provider;
  • Cash on Delivery, where available.

Payment availability may vary depending on the customer’s location, order value, product and other factors.

14Razorpay Payment Processing

Razorpay may process payment-related information necessary to:

  • Authorise transactions;
  • Process payments;
  • Verify payments;
  • Prevent fraud;
  • Process refunds;
  • Handle payment-related disputes;
  • Comply with applicable laws.

The Company does not directly store complete card details, CVV, UPI PIN, ATM/card PIN or banking passwords where such information is handled directly by Razorpay.

If a payment issue occurs, the customer may contact the Company. The Company will provide reasonable assistance and, where necessary, coordinate with Razorpay to investigate and resolve the issue. Customers will not ordinarily be required to independently coordinate with Razorpay for an issue relating to an order placed through the Website.

Where a bank, card issuer, UPI provider or financial institution requires verification directly from the customer, the customer may need to complete that verification.

15Cash on Delivery

Cash on Delivery may be available only for eligible orders and locations. The Company may apply reasonable verification measures before processing a COD order. COD availability may be affected by:

  • Delivery location;
  • Order value;
  • Product category;
  • Customer/order history;
  • Courier availability;
  • Fraud prevention measures;
  • Other operational considerations.

Any applicable COD charges will be displayed before order completion.

16Shipping and Delivery

Orders are shipped through independent courier/logistics partners. Estimated delivery times are communicated during checkout or through order confirmation. Delivery estimates may be affected by:

  • Courier delays;
  • Weather;
  • Public holidays;
  • Transportation disruptions;
  • High order volumes;
  • Incorrect address;
  • Customer unavailability;
  • Remote-area delivery;
  • Government restrictions;
  • Force majeure;
  • Other circumstances beyond reasonable control.

Estimated delivery dates are not guaranteed unless expressly stated otherwise. Where applicable law provides rights or remedies for delayed delivery, those rights will continue to apply.

17Delivery Address

Customers are responsible for providing complete and accurate delivery information. This may include:

  • Name;
  • House/flat number;
  • Street/locality;
  • City;
  • State;
  • PIN code;
  • Mobile number;
  • Other delivery instructions.

Incorrect or incomplete information may cause:

  • Delivery delays;
  • Failed delivery attempts;
  • Shipment return;
  • Additional operational costs.

18Failed Delivery

A delivery may fail because of:

  • Customer unavailability;
  • Incorrect address;
  • Incomplete address;
  • Customer refusal;
  • Inaccessible location;
  • Failure to respond to courier attempts;
  • Other circumstances attributable to the customer.

The courier may make additional delivery attempts according to its operational procedures. If the shipment is returned to the Company after unsuccessful delivery, the customer may contact the Company regarding available options.

19Return & Exchange

Returns and exchanges are governed by the Company’s separate Return & Exchange Policy, which forms part of these Terms. Customers should review it before purchasing.

The applicable policy includes rules relating to:

  • Return window;
  • Product condition;
  • Mandatory photographs;
  • Return pickup;
  • Return charges;
  • Exchange limits;
  • Exchange eligibility;
  • Return/exchange verification.

Nothing in the Return & Exchange Policy removes any mandatory consumer rights.

20Refunds

Refunds are governed by the Company’s separate Refund Policy, which forms part of these Terms. Refund processing may depend on:

  • Return approval;
  • Product verification;
  • Payment method;
  • Razorpay/payment processing;
  • Banking systems;
  • Required COD bank details;
  • Other applicable circumstances.

Customers should review the Refund Policy before placing an order.

21Return and Exchange Location

Where a return or exchange pickup is applicable, pickup will ordinarily be arranged from the same location where the original order was delivered. The pickup location cannot ordinarily be changed to another address.

Any exception will depend on operational feasibility and applicable law.

22Customer Responsibilities During Return/Exchange

Customers are responsible for:

  • Submitting requests within the applicable window;
  • Providing accurate information;
  • Uploading required photographs;
  • Keeping products in the required condition;
  • Keeping original packaging where required;
  • Making products available for pickup;
  • Providing accurate information required for refunds.

23Fraudulent or Abusive Activity

The Company may investigate suspicious activity including:

  • Fake orders;
  • Fraudulent payments;
  • Multiple accounts created for abuse;
  • False delivery claims;
  • False return claims;
  • Returning a different product;
  • Intentional product damage;
  • Refund abuse;
  • Promotional abuse;
  • Exchange abuse;
  • Other fraudulent activity.

Where fraudulent or unlawful activity is established, the Company may take appropriate action permitted by applicable law, including restricting transactions, suspending an account, cancelling fraudulent orders or reporting unlawful activity to appropriate authorities. This section does not restrict legitimate consumer rights.

24Customer Reviews and User Content

Customers may be allowed to submit reviews, ratings, comments, photographs, videos and other content. Customers are responsible for ensuring that submitted content:

  • Is truthful and not misleading;
  • Does not violate another person’s rights;
  • Does not contain unlawful material;
  • Does not contain abusive or threatening content;
  • Does not infringe intellectual property rights;
  • Does not contain unnecessary sensitive personal information.

The Company may moderate, remove or decline to publish content that violates applicable law or Website rules.

25Intellectual Property

All Website content, including where applicable the logo, brand name, product photographs, graphics, designs, Website layout, text, videos, icons, software, product descriptions and other original content, is owned by or licensed to the Company unless otherwise stated.

No customer may reproduce, copy, modify, distribute, sell, publish or commercially exploit Website content without prior written permission, except where permitted by applicable law.

26Prohibited Website Activities

Customers must not:

Customer personal information is handled in accordance with our Privacy Policy, which explains information collected, purpose of collection, data sharing, payment processing, courier information, return/exchange photographs, data retention, customer privacy requests, security measures and the privacy grievance process.

The Privacy Policy forms part of these Terms.

30Electronic Communications

By using the Website, customers may receive electronic communications relating to orders, payments, delivery, returns, exchanges, refunds, account activity and important Website/service changes.

Electronic communications may be sent through email, SMS, WhatsApp or other available communication methods where applicable.

31Force Majeure

The Company will not be responsible for delays or interruptions caused by circumstances beyond its reasonable control, including:

  • Natural disasters;
  • Extreme weather;
  • Floods;
  • Earthquakes;
  • Fire;
  • War;
  • Civil disturbances;
  • Government restrictions;
  • Epidemics/pandemics;

The Company will make reasonable efforts to resume affected services as soon as reasonably practicable. Nothing in this clause removes any mandatory rights available to consumers under applicable law.

32Disclaimer

Product information is provided based on information reasonably available to the Company. We do not guarantee that:

  • The Website will always be available without interruption;
  • Every Website feature will always operate without error;
  • Product images will appear identical on every device;
  • Delivery estimates will always be met;
  • Third-party services will always operate without interruption.

Nothing in this disclaimer excludes any liability or consumer right that cannot legally be excluded.

33Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be responsible for losses arising solely from circumstances beyond its reasonable control, including third-party service interruptions, courier disruptions, network failures or incorrect information provided by the customer.

Nothing in these Terms excludes or limits:

  • Liability that cannot legally be excluded;
  • Mandatory consumer rights;
  • Remedies available under applicable law;
  • Liability arising from fraud or wilful misconduct where such limitation is not legally permissible.

34Indemnification

To the extent permitted by applicable law, a customer may be responsible for losses or claims arising directly from the customer’s:

  • Fraudulent activity;
  • Unlawful use of the Website;
  • Intentional misuse of the Website;
  • Violation of these Terms;
  • Infringement of third-party rights;
  • Misuse of another person’s account or information.

This provision does not limit any rights or remedies available to consumers under applicable law.

35Account Suspension or Termination

The Company may suspend or terminate an account where reasonably necessary because of fraudulent activity, unlawful activity, security concerns, serious violation of these Terms, abuse of Website services or other legally permissible reasons.

Where reasonably appropriate, the customer may be notified of the relevant reason. Account suspension or termination will not remove any rights or obligations that have already accrued under applicable law.

36Changes to These Terms

We may update these Terms from time to time because of changes to our services, business practices, technology, applicable law or regulatory requirements.

The updated Terms will be published on the Website with a revised “Last Updated” date. Where required by applicable law, appropriate notice will be provided.

37Governing Law

These Terms shall be governed by the laws applicable in India. Any dispute shall be subject to the applicable legal and consumer dispute-resolution mechanisms available under Indian law.

Nothing in these Terms prevents a consumer from exercising any statutory right or remedy available under applicable law.

Customers may contact the Company’s grievance redressal contact regarding complaints relating to orders, payments, delivery, returns, exchanges, refunds, products, Website services, privacy and other consumer concerns.

39Severability

40Entire Agreement

These Terms, together with the following policies, form the principal terms governing the customer’s use of the Website and purchases:

  • Return & Exchange Policy;
  • Refund Policy;
  • Shipping Policy;
  • Cancellation Policy;
  • Other policies expressly published on the Website.

In case of conflict between a policy and mandatory applicable law, the applicable law will prevail. Where a specific policy applies to a particular transaction, that policy will govern that transaction to the extent consistent with these Terms and applicable law.
